Found while testing brave/brave-core#32668

Follow up of PR #32668 - The ToS notice red icon is shown on bottom address bar and notice is not shown on Top address bar on the same browser session

Steps to reproduce

1. Clean profile 1.87.63 or 1.86.x or 1.85.x
2. Enable rewards
3. Click on BAT icon,
4. Confirmed that ToS notice is shown as expected
5. Confirmed that ToS notice red icon isn't shown on the BAT icon
6. Go to 3 dot menu -> Settings->Appearance->Address bar->Select Bottom address bar option
7. Relaunch the browser
8. Open brave://rewards or NTP
9. Observe that ToS notice red icon is shown on the BAT icon
10. Open barve.com
11. Confirmed that ToS notice red icon is shown on BAT icon and isn't overlapping on the verified checkmark on brave.com

Actual result

The ToS notice red icon is shown on bottom address bar and notice is not shown on Top address bar on the same browser session
